The Question: Did a file ever exist on a particular computer?
The Answer: Yes
The Proof:
In this case the key player claimed he never had certain files in his computer. Prior to returning the computer to management, he had carefully deleted the files using Eraser 2000, a file shredder. File shredders not only delete files, but they actually write over the deleted area so recover of the deleted file is impossible.
Electronic Legal was able to prove that the file shredder was downloaded and installed. In addition, we were able to point to dozens of references to the files that were "never on the computer", including shortcuts, references in Internet history, references in deleted Recycle Bin indices, and even copies of the documents that were created by Microsoft Word during Words auto-save sessions.
